Mr. Berard joined Pollart Miller in its Denver office in 2020 after relocating from St. Louis, Missouri. He earned a Bachelor of Science in Economics from the University of Wisconsin – Madison and his Juris Doctor from Marquette University Law School. During law school, Mr. Berard clerked for a Milwaukee County Circuit Judge and State Appellate Court Judge. During the summers, he worked at a criminal defense and plaintiff litigation law firm.
Mr. Berard was admitted to the Illinois and Wisconsin Bars in 2011, the Missouri Bar in 2012, and the Colorado Bar in 2020. He has focused his practice on the defense of workers’ compensation claims and general liability claims since 2012. Mr. Berard has handled over 500 workers’ compensation claims and tried over 50 claims. He has litigated workers’ compensation claims throughout state administrative courts, circuit courts and appellate courts. He has worked for many national insurance carriers and third-party administrators.
Mr. Berard has successfully defended claims for small businesses with just a few employees to Fortune 500 companies with thousands. He has handled every type of claim from minor strains and routine surgeries to complex spine injuries and death cases. He has obtained many outright denials of workers’ compensation claims after trial. He has successfully defended repetitive trauma claims for common conditions such as carpal and cubital tunnel syndromes, as well as more serious conditions such as total shoulder and total knee replacements. He has also obtained favorable decisions in high exposure wage differential and permanent and total disability claims.
Mr. Berard has presented on various workers’ compensation topics to insurance carriers and third party administrators throughout Wisconsin, Illinois and Missouri. He looks forward to continuing to do the same in Colorado.
